Wilkes - Barre, Jany 3d 1844 S. D. Ingham, Esquire Dear Sir, This morning Mr McClintock for Mr Fisher, obtained a rule of court upon our Sheriff to bring the money arising from the Sale of The Harelton Co's locomotives "into court for distribution". I proposed that we would agree to consider the money in court, for the purpose of taking the ownership of the money. To this proposition Mr McClintock told me privately, that he did not understand the business; that the matter might rest as it is until he can write to Mr Fisher; and that he will then accept my proposition; and so the matter stands. They have thus adoptd the cheapest and most speedy method of testing the question of their right in our court. The Sheriff's reply to the rule will be, (unless we do agree to consider the money in court) that he has taken the receipt of the Plaintiff in the Execution for the money, as he was the purchaser. This will probably drive them to the acceptance of my proposition to agree that the money shall be considered in court. If they obtain the money, they cannot afterwards [deploy] the property with Success; - whether they can then prosecute us for making the sale admits of [2] much more doubt.
